These Terms of Service ("Terms") are a binding agreement between you and StoresWiki LLC ("we", "us"), Lewes, Delaware, USA, and govern your access to and use of Autogineer Cloud (the "Service"). By creating an account, clicking "I agree", or using the Service, you accept these Terms. If you do not agree, do not use the Service. Last updated 17 September 2026.
"Server" means a virtual private server (Linux container) you provision through the Service. "Content" means any data, code, or material you store, run, or transmit using a Server. "Plan" means the resource tier (vCPU, memory, disk, bandwidth) you select. "Order" means a purchase of a Plan for a billing term.
We may offer to help you move an existing site or application onto the Service at no charge. Any such help is provided on a best-efforts basis, is not a guarantee that a migration will succeed or be complete, and does not make us responsible for the data being moved — keep your own copy until you have checked the result. We will never ask you for the password or private key of a system you are moving away from; we agree a method with you instead.
Autogineer Cloud provides on-demand virtual private servers and optional one-click application and operating-system images. Servers are isolated Linux containers on our managed infrastructure. We manage the underlying host, network, and hypervisor; you manage everything inside your Server: the operating system, packages, applications, data, and security.
We may add, change, or discontinue features, images, and Plans. We will give reasonable notice of material changes that adversely affect an active paid Plan.
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You must provide accurate registration details, verify your email, and keep your credentials confidential. You are responsible for all activity under your account and for the root password you set on each Server. Notify us immediately of any unauthorized use.
Your use of the Service must at all times comply with our Acceptable Use Policy and Fair Usage Policy, which are incorporated into these Terms. Without limiting those policies, the following are strictly prohibited on any Server:
Content that is unlawful under the laws of the United States, the European Union, or the jurisdiction of your end users, including child sexual abuse material (CSAM), which is reported to the competent authorities without notice.
Malware, ransomware, spyware, botnet command-and-control, exploit kits, phishing pages, or credential-harvesting sites.
Unsolicited bulk email (spam), snowshoe spamming, list-washing, or operating an open SMTP relay. Outbound port 25 is closed by default on customer servers.
Unauthorized cryptocurrency mining, hash-rental, or proof-of-work workloads, and 'free-VPS'-style resource reselling that exists mainly to consume CPU.
Network abuse: port scanning, DoS/DDoS (as source or reflector), traffic amplification, brute-forcing, ARP/DNS spoofing, or unauthorized penetration of systems you do not own.
Anonymous or high-risk proxying / VPN exit / TOR exit relays operated to launder third-party traffic, and open proxies.
Fraud, carding, fake-document services, pill/pharma spam storefronts, and money-laundering infrastructure.
Content that infringes intellectual property (piracy, warez, unlicensed streaming) or violates a third party's privacy.
Adult content that is illegal, non-consensual, or fails to meet mandatory age-verification and record-keeping requirements.
Hate speech, incitement to violence, terrorist content, or the sale of weapons/controlled substances.
We reserve the right to determine, in our reasonable judgment, whether Content or activity violates this section.
You are responsible for keeping your Server's operating system and software patched, for configuring firewalls and access controls, for the legality of your Content, and for compliance with laws applicable to you and your end users (including data-protection and consumer laws).
We provide backup tools — on-demand and scheduled backups of the whole Server, and scheduled database dumps — and you are encouraged to use them. They are tools, not a guarantee: you remain responsible for maintaining at least one independent copy of any important data outside this platform, and we are not liable for data loss or for a backup or restore that does not complete.
Paid Plans are billed through our payment processors. Card payments are handled by Stripe and PayPal payments by PayPal; where offered, you may also pay by bank transfer against an invoice. Monthly Plans are billed in advance and renew automatically each month until cancelled. Multi-month terms (12, 24, or 48 months) are charged once, upfront, for the whole term and expire at the end of that term unless you place a new Order.
Prices are exclusive of taxes unless stated; you are responsible for any applicable VAT or sales tax. Server resources are reserved for you on provisioning, so fees are generally non-refundable except as stated in our Refund Policy. You authorize us to charge your payment method for all fees, renewals, and applicable taxes.
We may suspend or terminate a Server or your account, with or without prior notice depending on severity, for any of the following reasons:
(a) non-payment or a failed/expired subscription; (b) violation of these Terms, the Acceptable Use Policy, or the Fair Usage Policy; (c) hosting prohibited content listed in section 4; (d) confirmed malware, phishing, or a compromised Server actively attacking or spamming others; (e) sustained resource or bandwidth abuse that degrades the platform or other customers; (f) a valid legal order, abuse complaint, or law-enforcement request; (g) chargeback or suspected payment fraud; (h) risk to the security, integrity, or reputation of the platform.
For severe issues (active attacks, CSAM, malware distribution, network abuse) we may suspend immediately to protect the platform and third parties. For lesser issues we will normally notify you and give an opportunity to remedy where practical.
If a subscription lapses or a Server is suspended for a remediable reason, we retain its data for a 7-day grace period during which you can reactivate. After the grace period the Server and its data may be permanently deleted. Servers terminated for serious abuse or illegal content may be deleted without a grace period.
To protect the platform and our customers, we operate automated, host-side security and malware scanning of Server storage and monitor network patterns for abuse. We do not routinely inspect the substance of your Content, but we may access it where necessary to investigate a suspected violation, respond to a legal request, or resolve a technical issue. Detected malware may be reported to you and, where required, to the relevant authorities.
We aim for high availability but do not guarantee uninterrupted or error-free service. Except as expressly stated, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law.
To the maximum extent permitted by law, StoresWiki LLC shall not be liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill. Our aggregate liability arising from the Service is limited to the amounts you paid us in the three (3) months preceding the event giving rise to the claim. Nothing limits liability that cannot be excluded by law.
You agree to indemnify and hold harmless StoresWiki LLC and its personnel from claims, losses, and expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your breach of these Terms.
The Service can install third-party applications on your Server at your request. That software is not ours: it is licensed to you by its own authors under its own terms, and installing it through us does not grant you any licence from us or change the licence you receive from them. You are responsible for complying with each application's licence and for any fees its authors may charge for commercial use, additional features or support.
We install these applications from their publishers' own installers or official images and configure them to run on your Server. We give no warranty for third-party software, its fitness for your purpose, its security, or its continued availability, and we are not responsible for data held inside it. Application names and logos shown on this site belong to their respective owners and are used only to identify the software we can install.
An application is installed at the version current on the day your Server is built and is not silently upgraded afterwards. The panel offers a one-click update for the installed application and OS package updates for the Server, and we may publish security advisories or end-of-life notices for applications in our catalogue and notify you about them.
Publishing an advisory is not patching your Server. Applying updates, and deciding when it is safe to do so, remains your responsibility, and a Server running software with a known unfixed vulnerability remains your risk. We may suspend a Server under the Acceptable Use Policy if a compromise resulting from unpatched software begins to affect the platform or other customers.
IP addresses, including any dedicated IPv4 address and any IPv6 address assigned to your Server, are allocated to you for the duration of the Service and are not sold or transferred to you. A dedicated IPv4 address is a benefit of the Plans that include it; if you move to a Plan that does not include one, the address is released and cannot be reserved for you. Addresses may need to change for operational or abuse reasons, and we will give notice where we reasonably can.
You may set reverse DNS on an address assigned to you and point your own domains at your Server. You are responsible for the accuracy of records you set, for the content served on a domain you point at us, and for not using reverse DNS to impersonate another party. Certificates for your own domains are issued on your behalf by a public certificate authority once the domain resolves to your Server.
You are responsible for everything done under your account. You may invite other people to your account with a role, and you may issue API keys with defined scopes to use our API. Anything a team member or an API key does is treated as done by you, and it is your responsibility to revoke access you no longer intend to grant. We strongly recommend enabling two-factor authentication.
Keep API keys secret. A key is shown once, functions as a credential, and we cannot tell a request made by you from a request made by somebody holding your key. If you believe a key or password has been exposed, revoke it in the panel immediately.
You may apply the Service to your own customers under your own brand using our reseller features. If you do, you are the supplier to your customers: you set your own prices, take your own payments, and your own terms and privacy policy govern your relationship with them. We have no contract with your customers and will not support them directly. You remain liable to us for everything provisioned under your reseller account, including fees for capacity you have purchased, and you must not present yourself as us or imply that we are a party to your agreements.
Our Acceptable Use Policy and Fair Usage & Bandwidth Policy apply to every Server on the platform, including your customers' Servers, and you must pass them on. If you attach your own hardware, or connect a cloud-provider account so that we can build a host for you, you confirm that you are entitled to use that infrastructure and that any cost the provider charges is yours. Credentials you give us for that purpose are stored encrypted and are used only to build and manage the hosts you ask for; you can remove them at any time.
We may update these Terms; material changes will be posted here with a revised date and, where appropriate, notified by email. Continued use after changes take effect constitutes acceptance. These Terms are governed by the laws of the State of Delaware, USA, and the state and federal courts located in Delaware, USA have exclusive jurisdiction, subject to any mandatory consumer-protection rights in your country of residence.
